Civilian oversight of the security forces was further consolidated. The General Staff abstained from exerting pressure on political issues beyond its remit.

Güvenlik güçlerinin sivil gözetimi daha da güçlendirilmiştir. Genelkurmay Başkanlığı, sorumluluk alanı dışındaki siyasi konularda baskı uygulamaktan kaçınmıştır.

A law overhauling the Turkish Armed Forces’ disciplinary system, adopted in January 2013, provides for the conversion of disciplinary tribunals into administrative disciplinary committees, the abolition of solitary confinement and the strengthening of appeal mechanisms for disciplinary punishments.

Türk Silahlı Kuvvetlerinin disiplin sistemini revize eden ve Ocak 2013’te kabul edilen TSK Disiplin Kanunu ile disiplin mahkemelerinin idari disiplin kurullarına dönüştürülmesi, oda hapsi cezasının kaldırılması ve disiplin suçlarına yönelik temyiz mekanizmalarının güçlendirilmesi öngörülmektedir.

The report of an inter-party Parliamentary  Commission tasked with investigating coups and alleged ‘deep state’ networks was published in December. Judicial investigations into the 1980 coup and the ‘Postmodern Coup’ of 28 February 1997 continued.

Darbeleri ve iddia edilen “derin devlet” bağlantılarını soruşturmakla görevli olan partiler arası Meclis   Araştırma  Komisyonunun  raporu  Aralık  ayında   yayımlanmıştır.   1980  darbesine  ve  28 Şubat 1997 tarihli “Post-modern Darbeye” yönelik adli soruşturmalar devam etmiştir.

In November, a Court heard the two surviving perpetrators of the 1980 coup via video-conference. 103 suspects have been charged with involvement in the 28 February ‘Postmodern Coup’ of 1997.

Mahkeme, Kasım  ayında,  1980  darbesiyle  ilgili  olarak,  hayatta   olan  iki  sanığın  davasını  video  konferans aracılığıyla    görmüştür.    103    şüpheli,    1997    yılındaki    28    Şubat    “Post-modern    Darbesi”    ile bağlantısı olduğu gerekçesiyle suçlanmıştır.

Amendments made to the Law on Provincial Administrations, which is used as the legal basis for the use of military force upon request of governors in domestic security incidents, gave civilian authorities a broader oversight of military operations.

İç güvenlikle ilgili olaylarda, valilerin isteği üzerine askeri gücün kullanılmasına yönelik yasal dayanak teşkil eden İl İdaresi Kanunu’nda yapılan değişiklikler ile sivil makamlara askeri operasyonları   daha   kapsamlı   biçimde   gözetim   yetkisi   verilmiştir.

In July, the Internal Service Law of the Turkish armed forces, which broadly defined the duties of the military and contained one article to justify military intervention in politics, was amended.

  Türk   Silahlı   Kuvvetlerinin görevlerini kapsamlı bir biçimde tanımlayan ve Silahlı Kuvvetlerin siyasete müdahalesine gerekçe oluşturan bir madde içeren Türk Silahlı Kuvvetleri İç Hizmet Kanunu, Temmuz ayında değiştirilmiştir.

Military service has been  re-defined  and  the amendment  also clarified that  members of the Turkish  Armed Forces cannot engage in political activities. Civilian oversight of the Gendarmerie’s law enforcement activities, in particular, remained insufficient.

Askerlik hizmeti yeniden tanımlanmış ve yapılan değişiklik ile Türk Silahlı Kuvvetleri mensuplarının siyasi faaliyette bulunamayacakları açıklığa kavuşmuştur. Özellikle, Jandarmanın kolluk gücü faaliyetlerinin sivil gözetimi yetersiz kalmaya devam etmiştir.

There was only limited access to the Turkish Court of Accounts audit reports on security, defence and intelligence agencies.

Sayıştayın,   emniyet,    savunma ve   istihbarat   örgütleri ile   ilgili   mali   denetim   raporlarına  sınırlı erişim sağlanabilmiştir.

Military and civilian judicial investigations into the December 2011 Uludere incident in which 34 civilians lost their lives as a result of a military airstrike remained subject to a secrecy decision and were not finalised.

Askeri bir hava saldırısı neticesinde, 34 sivilin hayatını kaybettiği Aralık 2011’de gerçekleşen Uludere olayına ilişkin askeri ve sivil adli soruşturmalar bir gizlilik kararına tabi olmaya devam etmiş ve henüz sonuçlanmamıştır.

No administrative measure was taken to punish any individual for the incident. A parliamentary investigation report was published — with dissenting opinions — but did not clarify political or operational responsibility.

Bu olayla ilgili olarak herhangi bir şahsı cezalandırmak için hiçbir idari tedbir alınmamıştır. Muhalif görüşleri de içeren bir Meclis soruşturma raporu yayımlanmıştır; fakat siyasi veya operasyonel sorumluluk açıklığa kavuşturulmamıştır.

The civilian and military court systems continued to run in parallel. Increasing civilian control of the military requires the amendment of legal provisions on the composition and powers of the Supreme Military Council.

Sivil ve askeri mahkeme sistemleri paralel olarak işlemeye devam etmiştir. Silahlı Kuvvetler üzerinde sivil kontrolünün artırılması için Yüksek Askeri Şuranın yapısı ve yetkileri ile ilgili hukuki hükümlerin değiştirilmesi gerekmektedir.

Pending the finalisation of a new constitution, the Chief of the General Staff continued to report to the Prime Minister rather than the Minister of Defence.

Yeni Anayasa’nın hazırlık çalışmaları devam ederken, Genelkurmay Başkanı Milli Savunma Bakanına değil, Başbakana karşı sorumlu olmaya devam etmiştir.

Overall, progress was made in consolidating civilian oversight, in particular with the parliamentary investigation into past military coups and legislative amendments, confirming the profound shift in the balance of civil-military relations in favour of the civilian authorities. However, further reforms are needed, particularly as regards the military justice system and civilian oversight of the Gendarmerie.

Sonuç olarak, sivil-asker ilişkileri arasındaki dengede sivil makamlar lehine olan büyük değişimi teyit eden geçmiş askeri darbeler hakkındaki Meclis soruşturması ve mevzuat değişiklikleriyle, sivil gözetimin güçlendirilmesi konusunda ilerleme sağlanmıştır. Ancak, özellikle askeri yargı sistemi ve Jandarma Genel Komutanlığının sivil gözetimi hususlarında daha fazla reforma ihtiyaç duyulmaktadır.
