Parliament elected Turkey’s first Head Ombudsman in November 2012 and subsequently appointed five Ombudsmen. The Ombudsman Institution became operational and began receiving complaints in April 2013.

TBMM Türkiye’nin ilk Kamu Baş Denetçisini Kasım 2012’de seçmiş ve hemen ardından da beş Denetçi atamıştır. Kamu Denetçiliği Kurumu faaliyete geçmiş ve Nisan 2013’te şikâyetleri almaya başlamıştır.

The regulation establishing the modus operandi of the Institution follows the recommendations of the European Ombudsman and provides for final decision-making power to remain with the Head Ombudsman.

Kurumun çalışma usul ve esaslarını düzenleyen yönetmelik Avrupa Ombudsmanının tavsiye kararlarıyla uyumludur ve nihai karar verme yetkisinin Baş Denetçiye ait olmasını öngörmektedir.

It also provides for a simple application procedure and the admissibility of applications in languages other than Turkish.

Bu yönetmelik ile ayrıca, basit başvuru usulü ve Türkçe dışındaki dillerde yapılan başvuruların da kabul edilmesi öngörülmüştür.

Discussions are ongoing on draft amendments encompassing the right of own initiative, on-the-spot checks and the follow-up of Ombudsman’s recommendations by the parliament.

Resen girişimde bulunma, yerinde inceleme yapma ve Kamu Denetçisi tarafından verilen tavsiye kararlarının TBMM tarafından takibi yetkilerini kapsayan değişikliklere ilişkin görüşmeler devam etmektedir.

 As of July 2013, the Institution had received more than 3 400 applications concerning alleged violations relating to human rights, the rights of the disabled, civil service-related matters, social security, property rights, financial, economic and tax issues and the conduct of local administrations.

Temmuz 2013 itibarıyla Kuruma, insan hakları ihlali iddiaları, engelli hakları, kamu hizmetleri, sosyal güvenlik, mülkiyet hakları, mali, ekonomik konular ile vergi konuları ve yerel yönetimlerin işleyişine ilişkin olarak 3.400’ün üzerinde başvuru yapılmıştır.

As regards administrative acts of the Turkish Armed Forces, the Ombudsman considered eligible a number of complaints on dismissal and mistreatment during military service.

Kamu Denetçiliği Kurumu, Türk Silahlı Kuvvetlerinin idari işlemleri hakkında, ihraç edilme ve askerlik hizmeti sırasında kötü muameleye ilişkin bir dizi şikâyeti incelemeyi uygun bulmuştur.

The Ombudsman received 23 complaints relating to the Gezi Park protests, which were found eligible, without requiring prior exhaustion of administrative remedies.

Kurum, Gezi Parkı olayları ile ilgili olarak 23 şikâyet almış ve bunları idari başvuru yollarının tüketilmesini şart    koşmaksızın     incelemeye     uygun     bulmuştur.  

The Ombudsman has engaged with the EU and European Ombudsman Institution, and confirmed his participation in the European Network of Ombudsmen.

Kamu     Baş     Denetçisi,     AB     ve     Avrupa Ombudsmanı ile temasa geçmiş ve Avrupa Ombudsmanları Ağına katıldığını teyit etmiştir.

He should systematically seek to identify best practices in colleague institutions belonging to this Network with a view to benefiting from these and adapting them to the situation in Turkey.

Baş Denetçinin, bu ağa bağlı diğer kurumlarda yer alan en iyi uygulamaları, bunlardan yararlanmak ve bunları Türkiye’deki duruma uyarlamak amacıyla sistematik olarak tespit etmesi gerekmektedir.

Overall, the fact that the Ombudsman Institution became operational so quickly was an important step towards safeguarding citizens’ rights.

Sonuç olarak, Kamu Denetçiliği Kurumunun kısa sürede işlevsel hale gelmesi vatandaşların haklarının güvence altına alınması açısından önemli bir adımdır.

The Institution took a number of steps in the right direction. However, further efforts are needed to consolidate the trust of civil society in the Ombudsman Institution, to grant the Ombudsman the right of own initiative and of conducting on-the-spot checks, and to provide for parliamentary follow-up of his recommendations.

Kurum, doğru yönde bir dizi adım atmıştır. Ancak, sivil toplumun Kamu Denetçiliği Kurumuna güveninin güçlendirilmesi, Kamu Denetçisine resen girişimde bulunma ve yerinde inceleme yapma yetkisi tanınması ve verdiği tavsiye kararlarının TBMM tarafından takibinin yapılması için daha fazla çaba gerekmektedir.
